That Was Close

According to the Los Angeles Times:

Following major backlash about the scheduled release of a serial child molester through California’s elderly parole program, the 64-year-old is now facing new charges that could keep him behind bars.

News that David Allen Funston was set to be freed was met by outrage among victims, politicians and others. The former Sacramento County district attorney who prosecuted Funston said she was strongly opposed to his release: “This is one I’m screaming about.”

Funston, granted parole earlier this month, was set to be released on Thursday from state prison — but was rearrested that same day on new charges from a decades-old, untried case. The charges he’s facing are from a 1996 case in which he is accused of sexually assaulting a child in Roseville, according to the Placer County district attorney’s office.

In 1999, he was convicted of 16 counts of kidnapping and child molestation and had been serving three consecutive sentences of 25 years to life and one sentence of 20 years and eight months at the California Institution for Men in Chino. The sentences followed a string of cases out of Sacramento County in which prosecutors said Funston lured children under the age of 7 with candy and, in at least one case, a Barbie doll to kidnap and sexually assault them, often under the threat of violence.

He was described by a judge at his sentencing hearing as “the monster parents fear the most.”

Prosecutors in Placer County, at the time, decided not to pursue the case against Funston in Roseville given the severity of the sentences he received in Sacramento County.

But given his scheduled release from state prison, prosecutors decided to file new charges against him. Placer County Dist. Atty. Morgan Gire said “changes in state law and recent parole board failures” led to his improper release.

“This individual was previously sentenced to multiple life terms for extremely heinous crimes,” Gire said in a statement. “When changes in the law put our communities at risk, it is our duty to re-evaluate those cases and act accordingly. David Allen Funston committed very real crimes against a Placer County child, and the statute of limitations allows us to hold him accountable for those crimes.”

He is now being held without bail in the Placer County jail, booked on suspicion of lewd and lascivious acts against a child, according to prosecutors. Funston’s attorney, Maya Emig, said she had only recently learned about his arrest and hadn’t yet had time to fully review the matter.

But she noted that she believes “in the justice system and the rule of law.”

Emig called the Board of Parole Hearings’ decision to grant Funston elderly parole “lawful and just.”

California’s elderly parole program generally considers the release of prisoners who are older than 50 and have been incarcerated for at least 20 continuous years, considering whether someone poses an unreasonable risk to public safety.

In Funston’s case, commissioners said they did not believe Funston posed a significant danger because of the extensive self-help, therapy work and sex offender treatment classes he completed, as well as his detailed plan to avoid repeating his crimes, the remorse he expressed and his track record of good behavior in prison, according to a transcript from the Sept. 24 hearing.

At the hearing, Funston called himself a “selfish coward” for victimizing young children, and said he was “disgusted and ashamed of my behavior and have great remorse for the harm I caused my victims, their families in the community of Sacramento.”

“I’m truly sorry,” he said.

But victims of his crimes, as well as prosecutors and elected leaders have questioned the parole decision and called for its reversal.

“He’s one sick individual,” a victim of Funston’s violence told The Times. “What if he gets out and and tries to find his old victims and wants to kill us?”

A spokesperson for Gov. Gavin Newsom said the governor also did not agree with Funston’s release and had asked the board to review the case. However, Newsom has no authority to overturn the parole decision.

Some state lawmakers also cited Funston’s case as evidence that California’s elderly parole program needs reform, recently introducing a bill that would exclude people convicted of sexual crimes from being considered by the process.

THINK back to your first childhood crush. Maybe it was a classmate or a friend next door. Most likely, through school and into adulthood, your affections continued to focus on others in your approximate age group. But imagine if they did not.

By some estimates, 1 percent of the male population continues, long after puberty, to find themselves attracted to prepubescent children. These people are living with pedophilia, a sexual attraction to prepubescents that often constitutes a mental illness. Unfortunately, our laws are failing them and, consequently, ignoring opportunities to prevent child abuse.

The Diagnostic and Statistical Manual of Mental Disorders defines pedophilia as an intense and recurrent sexual interest in prepubescent children, and a disorder if it causes a person “marked distress or interpersonal difficulty” or if the person acts on his interests. Yet our laws ignore pedophilia until after the commission of a sexual offense, emphasizing punishment, not prevention.

Part of this failure stems from the misconception that pedophilia is the same as child molestation. One can live with pedophilia and not act on it. Sites like Virtuous Pedophiles provide support for pedophiles who do not molest children and believe that sex with children is wrong. It is not that these individuals are “inactive” or “nonpracticing” pedophiles, but rather that pedophilia is a status and not an act. In fact, research shows, about half of all child molesters are not sexually attracted to their victims.

A second misconception is that pedophilia is a choice. Recent research, while often limited to sex offenders — because of the stigma of pedophilia — suggests that the disorder may have neurological origins. Pedophilia could result from a failure in the brain to identify which environmental stimuli should provoke a sexual response. M.R.I.s of sex offenders with pedophilia show fewer of the neural pathways known as white matter in their brains. Men with pedophilia are three times more likely to be left-handed or ambidextrous, a finding that strongly suggests a neurological cause. Some findings also suggest that disturbances in neurodevelopment in utero or early childhood increase the risk of pedophilia. Studies have also shown that men with pedophilia have, on average, lower scores on tests of visual-spatial ability and verbal memory.

The Virtuous Pedophiles website is full of testimonials of people who vow never to touch a child and yet live in terror. They must hide their disorder from everyone they know — or risk losing educational and job opportunities, and face the prospect of harassment and even violence. Many feel isolated; some contemplate suicide. The psychologist Jesse Bering, author of “Perv: The Sexual Deviant in All of Us,” writes that people with pedophilia “aren’t living their lives in the closet; they’re eternally hunkered down in a panic room.”

While treatment cannot eliminate a pedophile’s sexual interests, a combination of cognitive-behavioral therapy and medication can help him to manage urges and avoid committing crimes.

But the reason we don’t know enough about effective treatment is because research has usually been limited to those who have committed crimes.

Our current law is inconsistent and irrational. For example, federal law and 20 states allow courts to issue a civil order committing a sex offender, particularly one with a diagnosis of pedophilia, to a mental health facility immediately after the completion of his sentence — under standards that are much more lax than for ordinary “civil commitment” for people with mental illness. And yet, when it comes to public policies that might help people with pedophilia to come forward and seek treatment before they offend, the law omits pedophilia from protection.

The Americans With Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973 prohibit discrimination against otherwise qualified individuals with mental disabilities, in areas such as employment, education and medical care. Congress, however, explicitly excluded pedophilia from protection under these two crucial laws.

It’s time to revisit these categorical exclusions. Without legal protection, a pedophile cannot risk seeking treatment or disclosing his status to anyone for support. He could lose his job, and future job prospects, if he is seen at a group-therapy session, asks for a reasonable accommodation to take medication or see a psychiatrist, or requests a limit in his interaction with children. Isolating individuals from appropriate employment and treatment only increases their risk of committing a crime.

There’s no question that the extension of civil rights protections to people with pedophilia must be weighed against the health and safety needs of others, especially kids. It stands to reason that a pedophile should not be hired as a grade-school teacher. But both the A.D.A. and the Rehabilitation Act contain exemptions for people who are “not otherwise qualified” for a job or who pose “a direct threat to the health and safety of others” that can’t be eliminated by a reasonable accommodation. (This is why employers don’t have to hire blind bus drivers or mentally unstable security guards.)

The direct-threat analysis rejects the idea that employers can rely on generalizations; they must assess the specific case and rely on evidence, not presuppositions. Those who worry that employers would be compelled to hire dangerous pedophiles should look to H.I.V. case law, where for years courts were highly conservative, erring on the side of finding a direct threat, even into the late 1990s, when medical authorities were in agreement that people with H.I.V. could work safely in, for example, food services.

Removing the pedophilia exclusion would not undermine criminal justice or its role in responding to child abuse. It would not make it easier, for example, for someone accused of child molestation to plead not guilty by reason of insanity.

A pedophile should be held responsible for his conduct — but not for the underlying attraction. Arguing for the rights of scorned and misunderstood groups is never popular, particularly when they are associated with real harm. But the fact that pedophilia is so despised is precisely why our responses to it, in criminal justice and mental health, have been so inconsistent and counterproductive. Acknowledging that pedophiles have a mental disorder, and removing the obstacles to their coming forward and seeking help, is not only the right thing to do, but it would also advance efforts to protect children from harm.

  • Cuba’s Interior Ministry reported that four men aboard a US-registered speedboat were killed after opening fire on a Cuban coast guard vessel near Cayo Falcones on Wednesday morning. Six additional passengers were wounded and received medical care.
    • The ministry said the Florida-registered vessel, carrying at least 10 people, was detected in Cuban waters off the country’s northern coast in Villa Clara province. When five members of the Cuban border guard approached the speedboat to verify its identity, the crew allegedly opened fire, injuring the Cuban commander.
    • The Cuban government later said that the 10 passengers who opened fire on soldiers were Cubans who had been living in the US and were seeking to infiltrate the island nation for the purpose of committing terrorism, the AP reports. The government claimed that the passengers on the boat “have a known history of criminal and violent activity.”

Star Trek: Starfleet Academy features a gay Klingon cadet. The show features a lesbian relationship between a mixed Klingon and Jem’Hadar and Tig Notaro, who plays a teacher at the Academy, as well as a Klingon man who dates a human.

“I won’t pretend that I wasn’t scared to take on this role. Part of me still is. Not because of the character himself, but because I knew the reaction that could come with it,” actor Karim Diané said of his character, Jay-Den Kraag, per Pink News.

To those who aren’t crazy about the warrior race being displayed as gay, Diané says their concerns are just “rooted in homophobia, racism, bigotry.” In the Star Trek universe, Klingons are a warrior race who are always ready for a fight and go into battle under the mantra “today is a good day to die.”

“But what matters more is this,” said Diané, “over the past few weeks since this show premiered, I’ve received countless messages from LGBTQ+ people around the world… people who feel seen, validated, and inspired by Jay-Den. Those messages outweigh every bit of negativity. Every single time.”

Episode 7, which aired this week, showed the Klingon character heading off to Ibiza to party down with his gay lover Kyle for spring break, or “All Worlds Day,” as it’s called on the show. Jay-Den Kraag didn’t even end up making it on the trip; he got sidetracked by another plot line, but Kyle came back terribly sunburned. Other cadets spent their All Worlds Day holidays with their families.

Of Star Trek creator Gene Roddenberry, Diané said he imagined a future that expanded who gets to be seen, heard, and valued. “A future where diversity isn’t merely tolerated but celebrated. Jay-Den doesn’t exist outside of that tradition. He exists because of it. ‘Infinite Diversity in Infinite Combinations’ isn’t just a catchy phrase Roddenberry tossed around. I believe he truly meant it,” he said.

Trekkers and Trekkies on X spoke out against the absurdity of taking a Star Trek series and making it about sexual identity, with one user saying “life long star trek fan but have not even started watching starfleet academy, i just can´t. from captain picard fighting the borg which was beyond epic to increasingly woke and insane storylines with every new series of star trek that has made it impossible to watch.”

“And then they wonder why people only watch the old shows, is because they were fun and entertaining not a platform to push an agenda,” said another.

Actor Ted Levine apologized recently for his iconic turn as cross-dressing serial killer Jame Gumb in the 1991  horror classic “The Silence of the Lambs,” saying that it was “f*cking wrong” that the film had “vilified” the apparent gender confusion of his character.

Levine told The Hollywood Reporter that his intent had always been to play Gumb — nicknamed “Buffalo Bill” — as a “f*cked-up heterosexual man” despite the fact that the character dresses in women’s clothing, wears makeup, and skins his female victims in an effort to make himself a suit of female flesh.

“There are certain aspects of the movie that don’t hold up too well,” he said. “We all know more, and I’m a lot wiser about transgender issues. There are some lines in that script and movie that are unfortunate.”

Levine said that when they were making the film — based on the 1988 Thomas Harris novel by the same title — he had not been particularly concerned, but that “over time and having gotten aware and worked with trans folks, and understanding a bit more about the culture and the reality of the meaning of gender — it’s unfortunate that the film vilified that, and it’s f*cking wrong. And you can quote me on that.”

“I didn’t play him as being gay or trans. I think he was just a f*cked-up heterosexual man. That’s what I was doing,” Levine explained.

Here We Go Again

According to the Daily Wire:

Two people were killed and at least three others critically injured after a man who identifies as a woman opened fire at a high school hockey game in Rhode Island.

Pawtucket Police Chief Tina Goncalves confirmed in a Monday evening press conference that Robert Dorgan, who goes by the name Roberta Esposito, killed himself after what she said was likely a targeted shooting stemming from a family dispute. A clip circulating on social media appears to show Dorgan’s daughter leaving a police station and telling reporters that her father “shot my family” and “he’s dead now.” The woman added that Dorgan “has mental health issues,” and “was very sick.”

Court records from 2020 confirm that Dorgan had undergone gender reassignment surgery. Dorgan claimed to North Providence Police at the time that his father-in-law attempted to throw him out of the house following his surgery. Around that time, Dorgan’s wife filed for divorce, initially citing “gender reassignment surgery, narcissistic + personality disorder traits” as the reason before crossing them out and writing “irreconcilable differences.”

Authorities have not publicly identified the victims, nor have they confirmed the precise relationships involved in the apparent family dispute. Police have also not released information about the weapon used.

This is the latest shooting perpetrated by a transgender-identifying attacker. Earlier this month, a man who identified as a woman and wore a dress killed 10 people at a Canadian school. Transgender-identifying shooters perpetrated deadly attacks on schools in Nashville in 2023 and in Minneapolis in 2025. The latter attack was the subject of the last question Turning Point USA founder Charlie Kirk was asked when he was assassinated in September.

New York City Mayor Zohran Mamdani has announced his preliminary budget, saying that in order to raise enough tax revenue to fill the gap in New York City‘s budget, New York Governor Kathy Hochul will have to allow him to raise taxes on the wealthiest New Yorkers and corporations, or that the tax burden will be passed onto property taxes, which would increase costs for everyday New Yorkers. The funding would primarily go to social services, as Mamdani presented on Tuesday.

Mamdani said that Hochul and Albany should raise income taxes on those earning over $1 million a year and the “most profitable corporations.” 

Mamdani, when asked about the prospect of raising property taxes, said that it should be a “last resort” and that the tax increases would have to be imposed on those who are the wealthiest in the city. The proposal, as a “last resort,” would be a raise of property taxes by 9.5 percent.

Without pursuing either of those two options, Mamdani said that the revenue gap would stay at around $4.7 billion.

  • Facebook and Meta founder Mark Zuckerberg has become the latest tech billionaire to ditch California in search of greener pastures and has ended up in Florida. The move from Zuckerberg comes as California is considering a 5 percent tax on the ultra-wealthy in the state.
  • The Federal Aviation Administration lifted a flight restriction that had grounded all flights to and from El Paso International Airport in Texas on Wednesday, after previously warning that the U.S. government “may use deadly force” against any aircraft in violation.
    • A Trump administration official told Fox News that the initial lockdown came in response to “Mexican cartel drones” that breached U.S. airspace.

  • January jobs report came out.
    • 130,000 private sector jobs were created. Unemployment went down to 4.3%.
    • There was an adjustment for the year 2025, down 425,000 jobs.
  • Wages have gone up beyond the inflation rate, but not a lot.
    • Prices are not going to go down to 2019 levels. Unfortunately, inflation wasn’t transitory.

Snyder from the U.S. District Court for the Central District of California ruled that California’s “No Secret Police Act” both discriminates against the federal government for solely applying to federal law enforcement and violates its power granted by the Constitution’s Supremacy Clause.

Democratic California Governor Gavin Newsom signed the law in September to ban Immigration and Customs Enforcement agents from wearing masks while making arrests, forcing them to show their faces. The Department of Homeland Security quickly jumped to condemn the law, calling it “a flagrant attempt to endanger” federal officers.

ICE agents currently face a more than 1,000% increase in assaults, a surge in doxxing efforts, and a roughly 8,000% jump in death threats, according to the Department of Homeland Security.

That’s What Los Angeles Needs!

According to the New York Post:

A radical left-wing group in Los Angeles has published a shocking 40-page roadmap to transform the nation’s second-largest city into a bizarre socialist experiment.

The Democratic Socialists of America’s LA chapter wants to straight-up seize private property through a “creative use of eminent domain,” take control of your neighborhood grocery store, and replace cops with unarmed social workers while shutting down jails.

The 3,500 member group has already helped elect several candidates to local office, and previously backed Nithya Raman, a DSA-member now running for mayor. They openly trash the Democratic Party establishment as capitalist sellouts and want to build “working class power” through what they call a “socialist mass organization.”

The manifesto, published in 2025 is more than 9,000-words long and gives an insight into the policies that a potential Mayor Raman has signed up to as a DSA member and could try to implement in LA. It targets the “status quo coalition” of elected officials, real estate developers, billionaires, nonprofits, and even some union leaders who’ve supposedly sold out workers.

They think they can actually pull this off in six to eight years through local elections and organizing.

“We are on the burning edge of the economic, climate, and moral crises that define this generation,” the manifesto warns, adding ominously: “The choice remains socialism or barbarism.”

So, what are the goals of the Democratic Socialists of America?

  • Seizing privately owned housing using eminent domain to seize private property and convert to public/social housing
  • Build city-owned municipal enterprises and expropriate corporations in essential industries (grocery, restaurants, internet, etc.)
  • Decommission Men’s Central Jail and don’t replace with any carceral facilities
  • Execute shift to 100% renewable energy by 2035 — complete fossil fuel elimination in 11 years
  • Make all public transportation free (buses, trains, bike share)
  • Publicly acquire and operate all energy systems — full public takeover of utilities
  • Reclaim private and public golf courses via zoning/legislative means for housing/parks
  • Divest public pension investments from war profiteers, defense contractors, and fossil fuel companies
  • Replace armed police with unarmed alternatives for traffic enforcement and mental health crises
  • End all contracts between public agencies and corporations profiting from war/fossil fuels (including Metro’s contracts)
  • Ban all unhosted short-term rentals (Airbnb, etc.)
  • Prosecute and permanently decertify all cops who kill
  • Noncitizen voting in all local elections
  • Vacancy tax on empty housing units
  • Universal rent control statewide
  • Automatic rent freezes and eviction moratoriums with any state of emergency

According to the Daily Wire:

The Super Bowl champion Seattle Seahawks are in for a hefty California tax bill following their 29-13 drubbing of the New England Patriots on Sunday, with some players expected to pay more in taxes than their Super Bowl earnings.

Each Seahawks player receives an individual bonus of $178,000 as negotiated by the NFL Players Association, while Patriots players will each receive $108,000.

Both Super Bowl teams are subject to California’s notorious “Jock Tax” imposed on out-of-state professional athletes, which will tax both respective teams on income from the eight “duty days” spent practicing and playing in the Golden State.

Jeffrey Degner, a research fellow in economics at the American Institute for Economic Research, told FOX Business that this tax alone will cut the average player’s Super Bowl bonuses in half at a minimum — without even taking into account additional state and federal taxes.

“What that means here is that the winning team, their take-home pay will be approximately $86,000. If you’re on the losing side, the take-home would be about $49,800,” Degner told FOX Business.

Each “duty day” includes any day spent in California practicing, participating in team meetings, traveling, playing in a game, or doing media events. The state taxes each player by applying the ratio of their duty days in the state to their total duty days overall, then claiming that share of the player’s income.

“The players have a really complex tax situation where they can have 10 or more different states that they’re having to file taxes for,” Degner said. “This is why a lot of these young players, it’s really important for teams to settle them in with sharp financial advisors and tax advisors so that they don’t lose their shirts, so to speak.”

Sport business reporter Kurt Badenhausen estimates that Seahawks quarterback Sam Darnold, with 8+ duty days taxed out of his massive three-year, $105 million deal with Seattle and a $178,000 bonus, will pay $249,000 in California state taxes.

Stanford University Finance Professor and Hoover Institution Fellow Joshua Rauh commented on the numbers, sarcastically complimenting California’s tax system for ensuring the “incentive to win is preserved” by taxing the Super Bowl loser more than the winner.

“If his team wins, Darnold will receive $178k and pay $249k to California in taxes for his time here, losing $71k. If his team loses he gets $103k and still pays over $235k in taxes, losing $135k. I presume California is declaring victory, as his incentive to win is preserved,” Rauh quipped.

California has the highest state income tax rate in the nation, while several states with NFL stadiums — including Tennessee, Texas, and Florida — impose no income tax on their residents or visitors, leading many to question whether future Super Bowls should be held in California.

In some Olympic news, Lindsey Von suffered a terrible crash in the downhill skiing. Last week, she tore her ACL but she decided to ski. About 200 yards into her race, she lost control and broke her left leg. She needed to be air lifted out and had surgery. Pray for her.

I am not watching the Olympics because I am tired of a bunch of privileged athletes, who make tons of money in their sports, making asses out of themselves. It turns me off.

Federal agents who defy California’s new mask ban won’t face enforcement from the LAPD, the police chief said.

“It wasn’t well thought out,” Chief Jim McDonnell said in a press conference Friday.

“The reality of one armed agency approaching another armed agency to create conflict over something that would be a misdemeanor at best or an infraction, it doesn’t make any sense,” McDonnell added.

The law, known as the “No Secret Police Act,” mandates visible identification and permits violations to be cited as misdemeanors. Governor Gavin Newsom signed the bill into law, it took effect January 1st. The Trump administration has challenged the statute, arguing it interferes with federal operations.

The Department of Justice is challenging the “No Secret Police Act” saying it’s unconstitutional, and creates risks for agents, including harassment.

Exceptions to the law include masks permitted for undercover operations, medical reasons, or specific protective gear, such as tactical helmets.

You’ve Got to be Kidding?!

According to the New York Post:

California drivers and Republican legislators are furious over a Democrat-led proposal that could see motorists taxed for each mile they drive.

With the state staring down a budget deficit in the billions and more Californians switching to electric vehicles, Democratic lawmakers are searching for new ways to shore up declining gas tax revenue.

Californians pay the second-highest gas price in the nation behind only Hawaii. In January, the average price was $4.23 per gallon, according to the American Automobile Association.

On Thursday, state legislators advanced Democrat Lori Wilson’s bill, AB 1421, which would direct the California Transportation Commission and the state Transportation Agency to continue studying options for a mileage-based tax, rather than implementing one.

Opponents of the proposal were out in force Saturday, with activists gathering at Cal Expo in Sacramento to collect signatures opposing a raft of new Democratic tax measures, including a potential mileage charge.

Under concepts outlined in the study, the tax could range from two to nine cents per mile. With California drivers logging roughly 11,400 miles a year on average, a mileage charge could cost motorists between $228 and $1,026 annually.

Beyond the price tag, critics warn that tracking drivers’ mileage could be both logistically complex and deeply invasive.

In its current form, the bill would commission a report examining equity concerns for low-income drivers who often travel longer distances in less fuel-efficient vehicles, analyze the potential impact of a weight-per-mile fee on commercial and electric vehicles, and outline regional and statewide options for implementing a road usage charge.

California has a $73 billion deficit according to the Hoover Institute.

(a) State funding for transportation comes mainly from six different fuel taxes and vehicle fees dedicated to specific purposes. These sources generated about $14,000,000,000 in the 2023–24 fiscal year.

(b) The gasoline excise tax is by far the largest of these charges. The tax is 57.9 cents per gallon and generated about $7,800,000,000 in fiscal year 2023–24.

(c) California relies on gasoline and diesel tax revenue to build and maintain its highways, public transit, and other transportation infrastructure, which is a problem in a state aggressively pushing a transition to electric vehicles (EVs).

(d) Since the passage of Senate Bill 1 (Chapter 5, Statutes of 2017), gas taxes have begun to lag, in large part due to Californians adopting lower emission vehicles. The state’s climate goals, including the switch to zero-emission vehicles (ZEVs) and reductions in statewide per capita vehicle miles traveled for light-duty vehicles, are projected to reduce fuel tax revenues in the coming years.

(e) California’s gas revenues have steadily increased over the last decade as lawmakers hike tax rates, but that curve is projected to turn downwards as more drivers switch to EVs.

(f) Californians have purchased more than a million EVs in the last four years, according to the California Energy Commission. Those numbers will continue to increase as a result of the state’s mandate for all new car sales to be ZEVs by 2035.

(g) The Legislative Analyst’s Office projects revenues will decline by as much as $2,000,000,000 annually by 2030 and up to $4,000,000,000 annually by 2035. A study by the Mineta Transportation Institute estimated a reduction in revenues of between $4,800,000,000 and $12,100,000,000 by 2040.

(h) The California Transportation Commission projects that the state will collect $31,300,000,000 less in fuel excise tax revenue due to increased fuel efficiency and the proliferation of ZEVs over the next decade.

(i) Collectively, various states and the federal government have undertaken research and exploration of possible revenue mechanisms to supplement or replace the fuel excise tax.

(j) In 2014, the Legislature passed Senate Bill 1077 (Chapter 835, Statutes of 2014) which created the Road Usage Charge Technical Advisory Committee (RUC TAC). The RUC TAC was charged with the development and evaluation of an authorized pilot program to assess the potential for a mileage-based financing mechanism for California’s roads and highways as an alternative to the fuel excise tax system.

(k) In 2017, California completed the SB 1077 pilot program, which enrolled more than 5,000 vehicles that reported more than 37,000,000 miles over a nine-month period. Importantly, the collection of revenue was simulated in the pilot program through mock invoices and payments.

(l) The final pilot program report found further testing of the revenue collection processes should be the next step to undertake in order for California to evaluate revenue flows and identify challenges, efficiencies, and synergies for possible road user charge implementation.

(m) Presently, the state is analyzing the financial impacts of a road user charge on supercommuters, as well as additional engagement with rural communities and tribal nations to better inform constituencies on a road charge concept.

(n) The benefit of a road use charge is that it could be structured to provide gas tax relief to low-income drivers.

(o) Implementing a road use charge in a way that appeals to both low- and moderate-income households and urban and rural communities across the state’s diverse geography will require significant education, negotiation, and compromise.

A 5-year-old boy and his father who were taken into custody by ICE during the agency’s illegal immigration crackdown in Minneapolis were freed over the weekend after a federal judge ordered their release.

Liam Conejo Ramos, 5, and his father, Adrian Conejo Arias, were released from a US Immigration and Customs Enforcement detention center in Texas on Saturday and returned to Minnesota on Sunday, according to Texas Rep. Joaquin Castro.

Arias, originally from Ecuador, and his young son were detained by ICE at their family home in a Minneapolis suburb on Jan. 20.

A picture of Liam wearing a blue bunny hat and a Spider-Man backpack while he was being taken by federal immigration agents sparked a firestorm of backlash over the Trump administration’s crackdown and immediate calls for his release.

Neighbors and school officials accused the feds of using the preschooler as “bait” by getting him to knock on the family’s door to lure his mother out of their home after Arias tried to flee.

The US Department of Homeland Security repeatedly refuted the claim. DHS Assistant Secretary Tricia McLaughlin said ICE didn’t target the boy, claiming his mother refused to take him after his father was apprehended, leaving him in the care of the agents.

US District Judge Fred Biery demanded the pair’s release in a scathing letter on Saturday.

“The case has its genesis in the ill-conceived and incompetently-implemented government pursuit of daily deportation quotas, apparently even if it requires traumatizing children,” Biery wrote in his ruling.

Biery previously ruled that Liam and his dad could not be removed from the US.

Messing, 57, bemoaned a trip to an appointment that dragged on for more than an hour early Saturday after her taxi encountered bumper-to-bumper traffic while an ambulance tried to squeeze through.

“The streets are a disaster. It hasn’t snowed in 5 days and the streets still haven’t been cleared. Poor ambulance sitting in [essentially] a parking lot with sirens going. I’m praying for the person needing emergency care,” she wrote in a post on X.

“I’ve lived here for 15 years (this go around) and this has never happened. The plows have always worked around the clock to get the city back to working. I wonder what happened? Hang in there New Yorkers,” the Brooklyn-born, NYU-educated star wrote.

Though Messing didn’t call out Mamdani by name, many linked her sarcastic sign-off to her past critiques of the self-declared socialist.

Messing, who voted for Andrew Cuomo in the mayoral election, crashed out on social media in November and posted a series of memes labeling Mamdani an “American-hating jihadist” and crudely nicknaming him “Osama bin Mamdani.”

Since then, she’s largely avoided mentioning Mamdani online. But the snowstorm tested her resolve — and many agreed with her sly jab at Hizzoner over the state of the streets.

Other Problems:

  • Trash is piling up since trash trucks cannot get to it.
  • The transit system is shutdown still.
  • Students were required to access schooling online, but no one could connect to the system.

The video, which the BBC said it has verified, captured the ICU nurse yelling at agents while they were driving away during a heated Jan. 13 protest before booting the back of the car, prompting them to jump out and tackle him to the ground, according to footage from the News Movement.  

The man — who was wearing similar clothing in the video to what Pretti had on when he was fatally shot last Saturday — was taken to the ground by at least five agents, who deployed tear gas into the whistle-blowing crowd during the wild confrontation.

Gee, Why Does California Have High Homelessness?

According to the New York Post:

A COVID-era program that guzzled $5 million of taxpayer money annually to serve booze to homeless alcoholics will finally shutter this year, San Francisco Mayor Daniel Lurie exclusively told The California Post.

“For years, San Francisco was spending $5 million a year to provide alcohol to people who were struggling with homelessness and addiction — it doesn’t make sense, and we’re ending it,” Lurie said.

The taxpayer tipple, called the Managed Alcohol Program (MAP), was created by the San Francisco Department of Public Health in April 2020, when the city began housing homeless people in hotels during lockdown.

The program served just 55 clients during its run — amounting to a $454,000 bar tab each.

To prevent chronic alcoholics from dangerous withdrawal while stores and bars were closed, clinicians brought metered doses of beer and liquor to clients.

But the scheme went on for six years, well after the pandemic ended.

According to the New York Post:

California Governor Gavin Newsom’s $236 million program to help those with severe mental illness who bounce between homelessness and jail has helped a measly 22 people since the its launch in 2022, a new report reveals.

Newsom’s CARE Court was billed as a “completely new paradigm” to get the mentally ill off the streets and into treatment, with up to 12,000 people expected to benefit, the Daily Mail reported.

But only 22 people have been sent to treatment over the past four years, after a state analysis found that up to 50,000 could be eligible for the program.

The 22 court-ordered cases were among roughly 3,000 petitions filed statewide as of October. Of those, only 706 were approved, including 684 voluntary agreements that never intended the meet program’s goal, according to the Daily Mail.

Newsom has denied the report.

According to Fox News:

House Republicans are coalescing around progressive “Squad” member Rep. Ilhan Omar, D-Minn., after she was attacked during a town hall in Minneapolis on Tuesday night.

“This is totally unacceptable. I am glad Rep. Omar is okay,” Rep. Pete Stauber, R-Minn., wrote on X in response to a video of the incident.

It’s a rare show of bipartisanship in the face of political violence that has become common in recent years amid increasingly volatile rhetoric on both sides.

Support for Omar came from both conservative and moderate Republicans after a man appeared to confront her and spray a substance on her before he was quickly subdued at her public event.

Of course it is Donald Trump’s fault. AOC made that clear:

“It is not a coincidence that after days of President Trump and [Vice President] Vance putting Rep. Omar in their crosshairs with slanderous public attacks, she gets assaulted at her town hall.”

Then Do Something About It

According to the New York Post:

The House Oversight Committee is probing “Squad” Rep. Ilhan Omar’s skyrocketing family wealth after a $9 billion Somali social services fraud scandal exploded in her district,The Post has learned. 

Oversight panel Chairman Rep. James Comer (R-Ky.) said staff lawyers are exploring the extraordinary step of subpoenaing Omar’s spouse over his allegedly shady business practices.

“We’re going to get answers, whether it’s through the Ethics Committee or the Oversight Committee, one of the two,” he told The Post.

Republicans want to know how Somali-born Omar (D-Minn.) and her politically-connected husband Tim Mynett went from nearly broke to being worth up to $30 million in just a year, according to her 2024 disclosure forms.

“There are a lot of questions as to how her husband accumulated so much wealth over the past two years,” Comer said. “It’s not possible. It’s not. I’m a money guy. It’s not possible.”

Separately, federal law enforcement is also probing.

“We are investigating all politicians potentially connected to any of this [fraud] in Minnesota. You can read between the lines,” said a law enforcement source.

Unlike the Biden administration, which took no apparent action, Team Trump is “on top of it,” the source said.

The comments came as The Post learned the FBI was briefed during the Biden administration on suspicions about an array of companies run by Omar’s hubby.

Investment firm Rose Lake Capital, formed by Mynett and partner Will Hailer in 2022, is part of a web of companies created by the lefty “Squad” member’s husband of five years.

Rose Lake Capital had a paltry $42.44 in its bank account in late 2022, according to court documents in a lawsuit against a related company filed in South Dakota.

Yet the firm rocketed in value from zero to up to $25 million in just a year, according to Omar’s 2024 filing.

Associates were perplexed enough in 2024 about alleged irregularities and questions about where the money was coming from that they brought information to the attention of federal investigators, sources said.

They wondered whether the businesses — including a winery — might be up to something improper, since none had a public track record.

Several prominent people had previously been listed as advising the Rose Lake firm, but are no longer present on its bright pink web page. They include former Sen. Max Baucus (D-Mont.), who once chaired the Senate Finance Committee and served as U.S. Ambassador to China under Barack Obama.

Baucus said he had a single phone call with Hailer back in 2022 about a proposed deal to make storage units. “Then nothing came of it” beyond occasional emails from Hailer. “That went on for about four or five months or so, then just radio silence,” he told The Post.

“He stopped writing his emails about the investment – about how well he’s doing, all that stuff. You can read between the lines – it sounded a little bit fishy,” he said. Baucus said no one ever asked to use his name as an “advisor” on the company website.

Also previously listed were former Rep. Collin Peterson (D-Minn.), who once chaired the House Agriculture Committee, and J. Peter Pham, a fellow at the Atlantic Council who served as President Trump’s Special Envoy to Africa’s Great Lakes Regions.

“Obviously I’ve seen reporting, including in The Post, about Will’s partner who I’ve never met and his wife [Omar] – Tim and his wife’s sudden coming into riches. But [I] can’t say anything about that, other than certainly I had no share in that,” said Pham, who indicated he had a single meeting about a potential deal to build solar panels in South Africa and was called an “advisor” by the company. Peterson didn’t respond to requests for comment.

Rose Lake’s website claims to have had officers with “previous” experience managing assets worth $60 billion, an amount that would make the firm a player that might attract notice.

But Wall Street insiders told The Post they had never heard of Rose Lake, or of anyone investing with them despite the firm boasting on its website that it had been running billions of dollars of assets under management and engaging in an array of high-end financial activities including “deals, mergers and acquisitions, debt restructuring and capital raising.”

Another Wall Street source expressed shock that Mynett — a longtime political consultant in Minnesota — was suddenly running a financial firm.

The firm also is not registered with the Securities and Exchange Commission, Wall Street’s top regulator, and doesn’t say how much it is managing now.

The Dodd Frank reforms imposed after the 2008 financial crisis created registration requirements for advisors overseeing $100 million in assets, or $150 million for private fund advisors, with some exceptions. So-called family offices can sidestep disclosure rules because they don’t solicit outside investors. Venture capital firms are also exempt and Rose Lake touts VC work as one of its specialties.

Still, Rose Lake’s boast on its website that it does private equity work and that its officers’ had billions in “previous” assets under management would suggest the fund would be required to register, said a former high-ranking SEC official. “I would continue to push on the disclosure issue because this looks funny,” the person said.

Financial experts have also pointed to multiple variations of similar names for Rose Lake entities as raising “red flags,” and that the company was scrubbing a list of its officers from its site in the wake of the multi-billion dollar fraud scheme involving the Somali community in his wife’s district after a front-page report from The Post.

In recent days, the firm has deactivated its LinkedIn page. Hailer is no longer mentioned on it.

His own LinkedIn page no longer lists the firm – although it does identify him as a co-owner of the eStCru winery, which he launched with Mynett in 2020.

Hailer previously worked as political director for then-Democratic National Committee chair Keith Ellison, now Minnesota’s attorney general.

The widening web of investigations are long overdue, House Majority Whip Rep. Tom Emmer (R-Minn.) told The Post.

“While Minnesotans have been getting fleeced to the tune of $9 billion by Somali fraudsters, Ilhan Omar and her husband have been raking in millions through their shady businesses,” he said.

“The explosion of wealth, plus the fact that convicted fraudsters helped fund Omar’s campaign, is worth an investigation by the Ethics Committee at the very least.”

An SEC spokesman would not comment when asked about Rose Lake and its filings. The Post has contacted Mynett, Hailer, and Rep. Omar’s office seeking comment.

According to the New York Post:

NYPD cops have been ordered to cut back on overtime — in what the rank-and-file fear is just the beginning under far-lefty Mayor Zohran Mamdani, who campaigned on eliminating the department’s entire OT budget, The Post has learned.

Officers have been told they need to reduce their extra time by nine to 11 hours next month as part of a cost-cutting initiative, multiple sources said Friday.

It wasn’t immediately clear if the department planned to keep those caps in place after the shortest month of the year or if further cuts were in the works.

Insiders said the order didn’t come down from City Hall and chalked it up to a short month with few big-ticket events.

Let’s go over some of the news in Minnesota and there is some big news.

Some activist group is suing the Trump administration for one of the dumbest things I have ever heard of. Let’s see if the activists can find the right judge.

Updates from Minnesota

Here are some updates from Minnesota after the Alex Pretti killing:

  • The Trump administration will partially remove Border Patrol from Minnesota.
  • Border Patrol chief Greg Bovino has been relieved.
  • There are major divides of the mass deportations within the Trump administration. There are call for Kristi Noam to resign or be fired.
  • Tom Homan is in Minnesota to tell the governor and mayor Jacob Fry the government will lower the number of federal officers if, and only if, local law enforcement helps.
    • Homen has a meeting with Jacob Fry this morning.
  • The Trump administration picked up a legal win on Monday after the 8th Circuit Court of Appeals temporarily blocked a Biden-appointed judge’s restrictions on federal immigration agents’ tactics in Minnesota while it appeals the decision. 
    • A three-judge panel said a ruling from District Judge Kate Menendez limiting how ICE officers could respond to protesters in Minnesota was “too broad” and “too vague,” temporarily pausing her order that barred agents from retaliating against anyone engaged in “peaceful and unobstructive protest activity” and from stopping vehicles without “reasonable articulable suspicion that [the occupants] are forcibly obstructing or interfering with” immigration enforcement operations. 
  • The Trump administration is preparing to pull funding from Minnesota and other “sanctuary” cities and states.
  • The activism goes way beyond the citizens of Minnesota.
    • The teacher’s union in St. Paul has walked out of the classrooms to protest ICE.
    • ANTIFA has been setting fire to hotels they think ICE agents are inhabiting.
    • There are multiple apps and social media groups that are tracking ICE and organizing protests. Apps that both Greg Prezzi and Rachel Good were using.

So Dumb

According to Fox News:

President Donald Trump said Sunday that it was “too late” to halt construction of a new ballroom at the White House, despite a newly filed lawsuit challenging the project.

In a post on Truth Social, Trump described the ballroom as “a GIFT (ZERO taxpayer funding) to the United States of America,” estimating its cost at $300 million and saying it was financed through private donations.

Trump said the lawsuit was brought by the National Trust for Historic Preservation, criticizing the group for filing it after construction was already underway.

“Why didn’t these obstructionists and troublemakers bring their baseless lawsuit much earlier?” he wrote.

Trump added that the East Wing was “changed, built and rebuilt over the years” and that “it bore no resemblance or relationship to the original building.”

On July 31, White House press secretary Karoline Leavitt announced the planned construction of a 90,000-square-foot ballroom. The sprawling ballroom will accommodate approximately 650 seated guests and will stay true to the classical design of the White House.

The White House does not have a formal ballroom, and the new ballroom will take the place of the current East Wing of the White House. 

Since his return to office, Trump has wasted no time in reshaping the look and feel of the White House and the National Mall.

These Guys Are For Law and Order?

According to the New York Post:

A New Jersey mom convicted of burning her two young children to death could soon walk free thanks to now-former Gov. Phil Murphy, who sparked outrage by commuting her sentence as he left office this week.

Maria Montalvo was serving a 100-year prison term after she was found guilty of murdering her 18-month-old daughter and 28-month-old son in 1996 – but under Murphy’s direction the 61-year-old Union Beach woman will have a chance at parole, according to reports.

Montalvo will continue to seek a new trial to get her conviction overturned even though she has a pathway to release, her lawyer, Josh Hood, told NJ.com.

Without Murphy’s intervention, she would not have been eligible for parole until 2054 when she was 90 years old, according to the Asbury Park Press.

Now, she’ll be able to argue her case to the state parole board potentially within months.

Later in the article:

Montalvo had baby Zoraida-Angelin Aponte and her older brother Rafael-Louis Aponte in her Volkswagen Jetta when she swung by a gas station to fill up $3 of gas in a plastic container in February 1994, said Santiago.

She then reached her in-laws’ home in Long Branch, where she “doused her children with the gasoline, and ignited it, killing them both,” he added.

The gruesome arson case was spurred by Montalvo’s husband telling her he wanted to end their relationship just days before, prosecutors reportedly argued at the time.

Santiago’s defense insisted the fire was an accident after the mother tried to light a cigarette in the car, which inadvertently lit up vapors that leaked from the gas can, according to the Asbury Park Press.

The parent also suffered severe burns across part of her face and body during the inferno.
