A federal judge, James Boasberg, has temporarily blocked the Trump administration’s use of the Alien Enemies Act to expedite deportations of Venezuelan nationals. The administration invoked this rarely-used 18th-century wartime law to deport alleged members of the Venezuelan gang Tren de Aragua, bypassing due process. Boasberg issued a 14-day restraining order and mandated the return of planes already airborne with deportees, citing concerns about constitutional violations and misuse of the law, which historically applies only in wartime scenarios.
Despite the order, reports indicate that hundreds of migrants were already transferred to El Salvador and Honduras, raising questions about compliance. The administration’s actions have sparked legal and constitutional debates, with critics arguing that the law was improperly applied to target gang members rather than enemy nations. A hearing is scheduled for Friday to address further arguments in the case.
The judge said: “I do not believe I can wait any longer and am required to act. A brief delay in their removal does not cause the government any harm.”
